An ATF proposal on interstate firearm transportation would treat reasonably necessary stops and interruptions as part of protected transport under 18 U.S.C. 926A. The comment period closes at midnight Eastern Time on August 4, 2026.

The proposal lists overnight lodging, food, fuel, vehicle maintenance, emergencies, medical treatment, and transfers between transportation modes. It would also cover lawfully possessed ammunition and accessories associated with the transported firearm. During a stop where vehicle storage is not possible, the proposal would require the firearm to be unloaded and placed in a locked container that keeps it and the ammunition from being readily accessible.

The proposal is not a final rule and does not protect an extended break unrelated to the trip. The trip must still begin and end in places where the traveler may lawfully possess and carry the firearm, and the proposal would not protect an accessory that is illegal at the origin or destination.
