The Supreme Court docket for Novotny v. Moore now shows the Maryland carry case distributed for the justices' September 28, 2026 conference. Petitioners filed their reply on September 2, completing the scheduled certiorari briefing in case No. 25-1324. The filing does not suspend Maryland's restrictions or reverse the Fourth Circuit. It puts the request for Supreme Court review in position for an initial conference decision.

The case asks whether Maryland's many prohibitions on carrying firearms in places frequented by the general public violate the Second and Fourteenth Amendments. Katherine Novotny, Susannah Kipke, other individual plaintiffs, Maryland Shall Issue, the Second Amendment Foundation, Firearms Policy Coalition, and the Maryland State Rifle and Pistol Association are among the petitioners. Maryland Governor Wes Moore and several state and local officials are the respondents.

What the petition puts before the Court

The petition identifies restrictions covering mass transit, many healthcare facilities, public parks and forests, places of amusement, restaurants and other establishments serving alcohol for on-site consumption, museums, stadiums, and additional locations. Those are not newly enacted by the September filing. They are the existing provisions the challengers want the Court to examine after the Fourth Circuit's January 20 decision in four consolidated appeals.
